Overview

A wrongful death action occurs when a person’s death is caused by the negligence or wanton act of another. The State of Alabama has a unique law with regards to wrongful death actions, wherein, the person bringing the claim of wrongful death is only entitled to punitive damages. This means that you may ask the jury to award an amount sufficient to punish the plaintiff for the wrong doing, but you may not ask for compensation (compensatory damages) for loss of future earning, etc. The statute of limitations for filing a wrongful death claim is generally two years from and after the death of the decedent.
