Alabama Restraining Orders

Overview.

Restraining Orders are legal documents that restrain a person from doing certain acts and/or ordering them to follow certain conditions. Restraining Orders are used to protect people from domestic abuse, harassment, and stalking. Parents and guardians may seek restraining orders on behalf of children. The most common types of restraining orders are:

  • Protection From Abuse Orders (PFA)

    o A PFA provides for limited protection for persons who have been threatened, harassed, or physically abuse by a spouse, former spouse, common-law or former common-law spouse, parent, child, person with whom the you have a child in common, or a present or former household member.
     
  • Temporary Restraining Orders

    o Temporary Restraining Orders are usually in effect for less than a month. This type of order is issued when a victim applies for a restraining order. Its purpose is to give the victim protection until a hearing can be held and a restraining order can be issued.

  • Permanent Restraining Orders

    o A permanent restraining order can be issued after a hearing has taken place. It can be in effect for a certain number of years in some states. Permanent restraining orders can be renewed or extended if the circumstances warrant a renewal.
