A wrongful death action is defined as a death caused by the negligence or wanton act of another. The State of Alabama has a unique law with regards to wrongful death actions. In Alabama, the person bringing the claim is only entitled to punitive damages. This means that you may ask the jury to award an amount sufficient to punish the plaintiff for the wrong doing. However, you may not ask for compensation for loss of future earning, etc. The statute of limitations for filing a wrongful death claim is generally two years from the date of the death. Therefore, you must file your claim within the statutorily prescribed two years. Otherwise, you will be barred from filing your claim.
